How to Avoid Property Transfer Pitfalls & Recording Minefields

This presentation will cover the procedure for transferring property in Marion County -- everything you need to know, from the proper filing of a sales disclosure form to the recording of deeds or other conveyance documents. Medicaid Updates

Claire E. Lewis, Law Office of Claire E. Lewis, has more than 25 years of experience in elder law. Ms. Lewis is a founding member and past-president of the Indiana chapter of National Academy of Elder Law Attorneys. She is a frequent author and speaker on elder law. She has served in an advisory capacity to Medicaid caseworkers throughout the state and trained caseworkers, attorneys, and elder care professionals on Medicaid rules and regulations. Ms. Lewis earned her J.D. from Indiana University School of Law-Indianapolis.

Dennis K. Frick is director of the Senior Law Project of Indiana Legal Services Inc. Mr. Frick has represented Medicaid clients in administrative appeals, rulemaking hearings, and in state and federal court. He is a frequent author on Medicaid and elder law issues. Mr. Frick earned his J.D. from the University of Chicago Law School.

The History of the Indiana Supreme Court CLE & Law Clerk Reunion
Hosted by IBA Appellate Practice Section

As part of the Indiana Supreme Court’s reunion with its former law clerks, the panel will discuss the biographies of former Justices Isaac Blackford, Andrew Davison and Amos Wade Jackson, and will also discuss several of the court’s landmark cases. A biographical dictionary of the justices of the Indiana Supreme Court is presently being drafted and has a target publication date of December 2009. 

The seminar will take place from 3:30 p.m. to 4:30 p.m., with the clerks' reunion reception to follow. All IBA Members who interact with the state courts are invited to attend, as are current and former law clerks.

Class Warfare in Subchapter K of the Internal Revenue Code

The taxation of partnership profits has been the subject of significant scrutiny in recent years. Hear national tax law expert Philip Postlewaite discuss recent federal legislation on the taxation of human capital. Based upon perceived abuses by private equity funds, federal legislation has been introduced that would mandate the taxation of partnership profits interests as ordinary income. Professor Postlewaite will present an overview of the current taxation of compensatory profits interests and capital interests in a partnership. He will also discuss the proposed legislation and how its proponents misunderstand the current operation of Subchapter K.

Philip F. Postlewaite is the Director of the Graduate Tax Program and is the Harry Horrow Professor in International Law at Northwestern University School of Law. He is an accomplished author, notably of the book "Partnership Taxation," the sixth edition published by Warren, Gorham & Lamont. He is a graduate of Texas Christian University; he earned a J.D. from University of California-Berkeley Law School and an LLM from New York University. He previously taught at University of Notre Dame Law School.
