| Insurance Coverage: It Pays When You Get It, But Can Cost You When You Don’t |
This program will help new lawyers understand how and why clients’ (or opposing parties’) insurance policies are extremely valuable in litigation. Focusing on commercial general liability policies, the program will highlight common mistakes made when seeking insurance coverage and ways to avoid or defeat typical coverage denials/defenses insurance companies raise. The program will also cover the attorney’s duty to explore this option under Professional Conduct Rules 1.1 and 1.2 and emerging case law as well as provide easy to implement strategies to avoid malpractice claims for failure to seek out insurance coverage for clients.
